Let's say the player has a winged helmet in their depot and they're your brother in real life and you can prove legally they passed away. Is it legal to obtain a winged helmet if you message Cipsoft about it? What happens to their account when they pass away?

Please note, I don't support breaking the Tibia rules and I understand this topic is sensitive and weird to even bring up. I've had players in English chat bring it up as a topic of conversation. My real-life brother actually passed away about 2 years ago and didn't play Tibia much but I couldn't imagine thinking about stealing his rares (not that he had any)

I will quote information from the TibiaGoals.com article :

We asked Cipsoft Community Support about their statement when it comes to using an account of someone who passed away, if it would be considered legal, what do they think. Here is what we received:

„This is indeed a tricky issue. Of course, we very much sympathize with the situation of relatives of players who passed away, and the desire to get access to the late loved one's Tibia account to preserve the memory is all too human. On the other hand, however, our position is still very much that accounts should be played by the people who created them, and by those players alone. Harsh as that may sound, therefore, we do not support such requests, even though I won't lie that the stories we sometimes hear about are truly heartbreaking. Incidentally, we have also decided not to put memorials of players into the game, even though we have received the occasional request and even though some very dear friends from the early days have passed away over the years as well ;/

I hope players understand our position - we really mean no disrespect, but a substantial number of problems would arise if we started to make special provisions for such sad occasions, including - but not limited to questions of verifying reports, the issue of fairness, e.g. why help some and not others etc. I sincerely hope players do not take this stance for indifference.”

Is this really official?
If I have legal document's of the last will of the person stating this should be given (Last will, testament, notarial act, court decisions) this should not go with " we do not support"/ " in our opinion"/ "we believe"- it should go with inheritance law.
There is nothing in Tibia rules, Tibia Service Agreement and if it goes for "Extended Tibia Service Agreement"- This is not even "sharing account" because there is only one "new" person, nor it is "account trading".
For those reasons - there should be an option of adding "Legacy contact" or option for your account being deleted if you pass away (where the last could be a troublesome for specific reasons.)

Yes, it is confirmed.
In my opinion, there should be no such option. You can always write an e-mail to Cipsoft and ask what you can do in such a situation, but as the information in the article shows, there's nothing you can do about it.  This is a really tough topic.

Tibia-rules

In severe cases the removal or modification of character skills, attributes and belongings, as well as the permanent removal of characters and accounts without any compensation may be considered.
